Terms of Service

1. Acceptance of Terms
By accessing or using DineCard (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. You must be at least 18 years of age to create an account or use DineCard.
2. Description of Service
DineCard is a digital menu creation and QR code hosting platform for restaurants. The Service allows restaurant owners to build, manage, and publish online menus accessible via unique URLs and scannable QR codes.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account and all activity that occurs under it.
- Authentication is handled via Google OAuth. You are responsible for the security of your Google account.
- Each account is limited to one restaurant profile.
- You must notify us immediately of any unauthorized access to your account.
4. Subscriptions & Billing
- Free Trial: New accounts receive a 14-day free trial with limited features (up to 100 menu items, 10 categories, and 1 AI menu scan).
- Monthly Plan: ₹99/month (India) or $9/month (Global). Cancel anytime.
- Yearly Plan: ₹999/year (India) or $99/year (Global).
- Payment Processing: Payments are processed by Razorpay for users in India and Dodo Payments for users outside India. Global plans include a 14-day free trial; you will not be charged until the trial period ends, and you may cancel at any time during the trial. DineCard does not store your payment card details.
- Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date.
- Cancellation takes effect at the end of your current billing period. You retain access until then.
- No refunds are issued for partial billing periods.
- When a plan or trial expires without renewal, your menu URL and QR code go offline until you subscribe.
5. Your Content
You retain full ownership of all content you upload to DineCard, including menu items, images, descriptions, and restaurant information.
- By using the Service, you grant DineCard a non-exclusive, worldwide license to host, display, and distribute your content solely as part of operating the Service.
- You are responsible for ensuring that your content does not violate any applicable laws, regulations, or third-party rights (including intellectual property and privacy rights).
- We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.
6. Acceptable Use
You agree not to:
- Use DineCard for any unlawful or fraudulent purpose
- Upload spam, misleading content, or content that infringes on intellectual property rights
- Attempt to access other users' accounts or data
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts, bots, or scrapers to access or extract data from the Service
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Service
7. Menu Visitor Data
When your customers scan your QR code or visit your menu page, we collect minimal anonymous data (such as user agent and referrer information) for your analytics dashboard. No personally identifiable information is collected from your customers.
As the restaurant owner, you are responsible for informing your customers that anonymous analytics data is collected when they visit your digital menu.
8. AI-Powered Features
- DineCard uses third-party AI services (Anthropic Claude) to power menu extraction from images and the support chat.
- AI-generated outputs may not be 100% accurate. You are responsible for reviewing and verifying all extracted menu data before publishing.
- Support chat messages are processed by AI in real time and are not permanently stored by DineCard.
- By using AI features, you acknowledge that your inputs (menu images, chat messages) may be sent to third-party AI providers for processing.
9. Intellectual Property
The DineCard name, logo, software, design, and all related intellectual property are owned by DineCard. You may not use our branding without prior written permission.
Your restaurant URL (e.g., yourslug.dinecard.in) is provided as part of the Service and does not confer any ownership rights over the subdomain. We reserve the right to reclaim or reassign slugs for inactive or terminated accounts.
10. Limitation of Liability
- The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.
- DineCard is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- In no event shall DineCard's total liability exceed the amount you have paid to DineCard in the 12 months preceding the event giving rise to the claim.
- DineCard does not guarantee uninterrupted or error-free operation of the Service.
11. Indemnification
You agree to indemnify, defend, and hold harmless DineCard, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.
12. Termination
- We may suspend or terminate your account at any time if you violate these Terms or engage in activity that harms the Service or other users.
- You may delete your account at any time by contacting us at support@dinecard.in. Upon deletion, all your data (restaurant profile, menu items, analytics) will be permanently removed.
- Termination does not entitle you to a refund of any fees already paid.
13. Governing Law & Disputes
- India Users: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
- Global Users: These Terms are governed by the laws of India. Disputes may be resolved through binding arbitration in accordance with applicable arbitration rules.
- Before initiating any formal proceedings, both parties agree to attempt informal resolution by contacting each other and negotiating in good faith for at least 30 days.
14. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or an in-app notice. Your continued use of DineCard after such changes constitutes your acceptance of the updated Terms.
